By using the Service, you agree to Kontakme's Terms and Conditions and Privacy Policy:
Kontaxio is operated by Kontakme LLC, a business registered in the State of New York. Business address is located at 142 East 98th St., New York City, 10029 with business registration # 46-3391674.
Kontaxio (herein referred to as the 'Service') is a managed subscription service that makes it easier for apartment building owners to add or upgrade their apartment facilities and in-building services to provide an extra level of convenience and security to their tenants.
The Kontaxio Service is made up of the following*:
1. Door Access Control for Smartphones
2. Package Holding and Self-Service Package Retrieval
3. Door Cam for Smartphones
*Some of the services may not be available in your apartment building. The services are optimized for smartphones, but they can be accessed also from tablets and PC's using a regular Internet Browser. The Door Cam's video stream has been tested on the following Internet browsers:
1. Safari for Mac OS and Mobile Safari for iOS devices.
2. Google Chrome for Mac OS, Windows and Android Devices
3. Firefox for Mac OS, Windows and Android devices
4. Samsung Internet browser for Android devices
Internet connection is required to access the Services.
TERMS AND CONDITIONS, PRIVACY POLICIES
1. Subscription Fees and Refunds
a. The building owner will inform you if the services offered are free add-on service or not. If this is offered as a paid subscription service in the building where you live, you will get the door access service as a free service. The Door Cam and the Package Holding (if available in your building) will be paid subscriptions.
b. Chargeable services will require a subscription that is auto charged on a monthly basis until cancelled. In the event that a user decides to cancel a service or the account, Kontakme does not offer refunds for the remainder of the subscription period.
c. Each building resident will be issued with a unique username and password. (DO NOT SHARE the access credentials to anybody as this is grounds for terminating your subscription).
d. Mobile data charges will apply and are not included in the subscription fee.
f. Subscription fees are not included in the apartment lease unless specified in the contract or through official communications.
g. Fees:
- Door Access: Free
- Door Cam: $5.00/month
- Package Holding: $15.00/month
- Package extended storage: $2.00/day ; requires advance notification.
2. Use of IP address tracking and cookies
a. We are tracking user IP addresses to determine where users are located when they use the service.
b. We use cookies to determine how to properly present our services to the user's devices.
3. Email, mobile number
a. A valid email address is required to create an account, for password reset and for other notification purposes.
b. A mobile number is required for phone support purposes. Kontakme will not entertain calls from phone numbers that are not in our records.
4. Proof of Address and Photo ID
a.. Only tenants of the apartment building are allowed to use the online services.
b. For security reasons, to avail of the services, a user needs to provide proof that they live in the building and that they are indeed who they claim they are. Example of documents : Billing statements, Package labels, Tenant Lease Contract , Government Issued Photo ID clearly showing the name, and apartment address of the tenant.
5. Door Access
a. We highly recommend you always bring your physical keys with you whenever possible just in case there are technical issues with the service.
b. The system logs all "Door Unlocking" events.
c. Kontakme is not authorized nor required to remotely open doors for tenants or delivery personnel.
d. The building admin/superintendent or Kontakme can cancel the door access control of a tenant or of the whole building at any time without prior notice if it deems that security has been compromised.
7. Door Cam
a. Kontakme does not keep a record of the door cam video streams.
Notes:
i. Other tenants can take a screenshot of the video or record video streams using a separate personal recording device at their own discretion.
ii. This currently works only with Safari and Firefox browsers.
iii. This does not support two-way audio communications as of the moment.
8. Package Holding
a. Not all Kontakme enabled buildings have this service. If the Package Holding service is available to the tenants, Kontakme will assign an authorized personnel who will visit the apartment lobby on a scheduled basis (every hour or as needed).
b. The Kontakme personnel will:
i. collect and deposit packages left out in the open into the shared locker.
ii. notify the owner of the package that the package(s) have been deposited in the shared locker via the email address they have provided during the registration.
iii. notify the owner of the package that the package(s) have NOT been deposited in the shared locker for the following reasons:
- there is no space available
- package is too big
- package contains perishable items
- package contains any type of food items
- package is clearly damaged, opened, leaking, very wet or emitting a bad odor.
c. Kontakme reserves the right to remove 'over-staying' or 'unclaimed packages' and place them outside the locker. Kontakme will hold packages in the lockers for 24 hours only especially if there are large volumes of packages arriving everyday. Kontakme can be requested in advance to STORE the package for an extended period for an additional fee of 2 USD per day. This normally happens when the tenant is out of town for extended periods. To request for extended storage, please email us at customercare@kontax.io.
d. Kontakme requests all subscribers to be considerate of others by keeping the locker clean. Subscribers who leave their empty packages and wrappings in the locker will be refused service in the future in the first offense.
e. Kontakme reserves the right to refuse service to tenants who are proven to have vandalized the lockers, cameras and other Kontakme components or have used the locker in a manner that may cause harm to other users or may disrupt the service or if they habitually disregard the locker guidelines.
f. Only tenants who have been notified that they have packages in the locker can open the locker. A virtual key will be automatically provided in the web app in the tenant's smartphone once the Kontakme personnel have deposited the package in the shared locker.
g. Kontakme will demand financial compensation from tenants who are caught vandalizing the shared lockers.
h. The system logs all "Door Unlocking" events of the locker. For this reason, tenants are required to close the locker after retrieving their own package(s) even if there is another tenant waiting to retrieve their package. Tenants who opened the locker are required to politely reject requests from other tenants or people to check if they have packages inside the shared locker.
i. Where applicable, Kontakme will deploy a video recorder to record activities around the locker.
j Tenants are required to wait for their turn to retrieve their own packages (if they have been notified via email) in the event that someone is already accessing the locker.
9. Personal information
a. Your name, email address, mobile number and apartment unit number is not shared with 3rd party service providers and marketeers.
b. However, certain events that involve law enforcement may require Kontakme to share your information to the authorities especially during an investigation of a crime or for crime prevention purposes.
10. Lost, hacked or stolen devices, usernames and passwords
a. Tenants who use the Kontaxio service in their smartphones, tablets or computers are obligated to report to Kontakme as soon as possible if their devices gets stolen, if it gets lost or if they suspect that they are hacked to prevent security breach in the building.
b. Kontakme will cancel the subscriptions of compromised accounts and a new user credential shall be provided.
11. Security and Forced Cancellations
a. Kontakme reserves the right to cancel a user's access to the online service without prior notice if the user violates the user guidelines or if malicious activities are detected on the user's account.
b. The Services of tenants are automatically expired once they end their contract with the building owner.
c. For apartment units with multiple tenants, the signatory to the contract has the authority to cancel their housemate's user account. Note that Kontakme does not issue refunds in this cases.
d. In case of a security breach in the Kontaxio System, Kontakme shall inform all clients of the breach within 48 hours.
e. Kontakme reserves the right to terminate the services of the tenant who refuse to pay the subscription fees, or have used illegal payment methods.
12. Service Availability
a. The services will operate 24 x 7 with announced and unannounced downtimes for us to perform necessary maintenance work.
b. Kontakme shall announce all major maintenance work that will contribute to a service downtime.
13. Technical Support
a. For concerns regarding the Service, please contact us at customercare@kontax.io. Kontaxio Service will address email requests within 8 hours.
14. Theft Reporting
a. Tenants who are victims of package theft are encouraged to report the incident to the nearest police station. Kontakme can assist in the investigation.
b. In cases when a Kontaxio locker has been broken into, Kontaxio will report the incident to the police and will inform all the tenants who have packages in the locker during the time of the incident.
15. Liability for Lost / Damage Packages
a. The Kontaxio Package Holding Service is an add-on service to prevent theft that is usually committed by non-residents of the building (trespassers, delivery personnel, thieves and abusive visitors).
b. Kontakme will not be held liable for stolen or lost packages that are beyond our control. These events include forced entry, building fire, flooding, acts of nature and acts of man that are beyond our control. Kontakme will however assist in investigating the issue.
c. Damages to packages are likely caused by mishandling of the packages by the shipping or delivery service, hence, Kontakme shall not be held liable for damages to the packages.
